Update to the Global MLS Rules and Regulations CCP

Effective September 1, 2023, the violation of the Clear Cooperation Policy (CCP) rule from NAR will be moved from a standard violation to a more severe infraction, per the GMLS Board of Directors vote.

CCP has been a rule in REALTOR® MLS’ across the country since 2020. If you publicly market a listing in the GMLS Service area, it must be in the GMLS within 1 business day if not before. Here is the rule by which the wording will not change:

Section 2 – Clear Cooperation

  • Within one (1) business day of marketing a property to the public, the listing broker must submit the listing to the MLS for cooperation with other MLS participants. Public marketing includes, but is not limited to, flyers displayed in windows, yard signs, digital marketing on public facing websites, brokerage website displays (including IDX and VOW), digital communication marketing (email blasts), multi-brokerage listing sharing networks, and applications available to the general public.
  • Exclusive listing information for required property types must be filed and distributed to other MLS Participants for cooperation under the Clear Cooperation Policy. This applies to listings filed under Section 2 and listings exempt from distribution under Section 2.16 of these Rules and Regulations, and any other situation where the listing broker is publicly marketing an exclusive listing that is required to be filed with the service and is not currently available to other MLS Participants.

 

Effective September 1, 2023, a violation of the Clear Cooperation Policy will result in:

  • Initial Fine: $1500
  • 2nd Violation: $3000
  • 3rd Violation: Suspension (not to exceed 90 days)

Please be aware that many rules apply to entering listings in the Global MLS, CCP is about the public marketing of a listing.
